Defendant's Hospitalization Forces Recess in Deliberate Interference Trial
NEWINGTON, CT, Jun 14, 2002--The federal trial of a Florida Citizens Band enthusiast accused of interfering with Amateur Radio operations and transmitting without a license has recessed until June 17. The trial of Willam Flippo of Jupiter began June 10, but it recessed June 13 after the defendant was hospitalized. Flippo, 59, faces four counts of operating without a license and four counts of deliberate and malicious interference.
Federal prosecutor Neil Karabdil has asked Federal District Court Judge Daniel T.K. Hurley to revoke Flippo's bond. The judge is said to be keeping an eye on the situation and has requested a report on Flippo's medical condition. The defendant was released from the hospital after an overnight stay. He remains free on $100,000 bond.
Known in CB circles as "Rabbit Ears," Flippo has been prohibited as a condition of his release from making radio transmissions and from contacting any witnesses in the case. Following his criminal mischief conviction in state court last year, a judge sentenced Flippo to one year's probation and ordered him to dispose of any radio equipment in his possession. The state case stemmed from a charge that Flippo had rammed his vehicle into the car of a local amateur, Ed Petzolt, K1LNC. At the time of the incident nearly three years ago, Petzolt was assisting the FCC in tracking down the malicious interference attributed to Flippo.
The latest development in the case came after testimony from former FCC agent Larry Sowers, who detailed the allegations against Flippo, and from Petzolt, who, among other things, outlined for the jury the differences between Citizens Band and Amateur Radio.
The federal trial, which is taking place in West Palm Beach, was postponed twice last year after Flippo argued successfully that serious health problems would prevent him from participating. He made similar claims earlier this month during another hearing to determine if he was capable of standing trial. A federal magistrate determined, however, that Flippo was competent to stand trial, and the trial date was set.
Federal authorities arrested Flippo in July 2000. The criminal charges now on trial cover violations allegedly committed between June 1999 and April of 2000. Each count carries a maximum penalty of one year in prison and a $10,000 fine. The defendant already faces a $20,000 fine levied in 1999 for unlicensed operation, willful and malicious interference to Amateur Radio communications, and failure to let the FCC inspect his radio equipment.
In January 2000, the FCC gave Flippo 30 days to pay and referred the matter to the US Attorney after he failed to do so and the interference complaints continued.
Personnel from the FCC's Tampa District Office followed up on complaints from amateurs that Flippo had regularly interfered with amateur operations, especially on 10 and 2 meters. FCC personnel visited the Jupiter area at least twice in 1999 and reported tracking the offending signals to Flippo's residence. |

phychoradio.... Why would you want to pirate any way??? Your right stay on cb and keep the interferance down and chances of being caught are about the same as winning the lotto. Flippo's story is well know here in Tampabay it has been on TV even frount page on the papers here .... although to us HAMS dismay the paper called him a roge HAM ! See its like this the FCC is out there they do catch people just go read the ARRL inforcement logs. See freebander like freezman and others like him dont understand it is not that hard to track someone even mobile today even with my direction finder give me some time i can find them too and when they pop up on 10 meters there asking for it. Time/phase finders and even the old loops like i use work real well .... quick story a few years back here in tampa/ st.pete we had a bootleger who would go around dialing 911 on the local repeaters he did it dozens of times well one day he was on and it just happened the local club had a fox hunt going so guess who became the fox! Well soon they had him tracked down to a few bks in st. pete and one of the hams came up in back of a car and saw him dialing while the tones could be heard Well got ya now they had a plate it just so happened the HAM was a Pinellas County Sheriff depty and got a marked car backup since in Florida miss use of 911 can be a felony. We haven't see that problem since. |

This is true Bruce. If more people knew just how easily and quickly the feds can track you down when they want to there would be fewer illegal amps.
Just curious Bruce are you a licensed Amateur Radio OP? Don,t state the call sign as it is too easy to identify the owner. Just being curious. |

I saw a HAMRADIO computer controled phased ant direction finder that as the driver went down the the GPS recorder the exact location of the car and the direction that the signal was comming from in min 2 cars going at 90 deg angles could paint a real nice plot and this stuff was home brew! As for being a HAM yes for almost 40 years my call is widly known and im in the phone book Ive had this call for almost 30 years and made thousands of contacts sent well over 1000 QSL cards if anyone wants to call me why not? O by the way im still tring to correct the zip code for some reason they latch onto one that is 20 years old.... HA goverment... |

Hey Bruce, did ya read the part that said better yet, STAY OFF hams and stay on cb? In my collection of radios I have a few that will talk off cb, and a few that are ham radios, like my 2950. However I realize and so should everyone else that te FCC and the operators of other bands do not dig BOOTLEGING one bit. In fact these guys are happy to team up with law enforcment to get a bootleger or a pirate station. I think, from what I have seen and heard from operators, is who cares what the hell happens on 11 meter as long as that is where it stays. So like I said, if someone wants to get stupid, stay on cb. Yep got that about stay on cb and your right about most hams as long as its stays out on 10 meters dont care Most of these yokkles that get caugh just get board with cb and expand outward into frequencys that are still being used as for colections of radios even though i got rid of most of my stuff this last year including my 2950 im not hurting either now to keep the wife happy |

A Florida Citizens Band enthusiast accused of jamming Amateur Radio operations and transmitting without a license was convicted in
federal court June 19 on eight misdemeanor counts. Willam Flippo of Jupiter was found guilty of four counts of operating without a
license and four counts of deliberate and malicious interference.
Federal District Court Judge Daniel T.K. Hurley noted that, while the charges were misdemeanors, it was important that the amateur airwaves be free of interference in the event of an emergency. He ordered that Flippo remain in custody and undergo a psychiatric
evaluation prior to sentencing.
The prosecutor in the case, Neil Karabdil, credited members of the Amateur Radio community with bringing Flippo to justice. The list
included ARRL 1999 ARRL International Humanitarian Award winner Ed Petzolt, K1LNC, who helped the FCC gather evidence in the case; Bert
Morschi, AG4BV; Palm Beach County Emergency Coordinator Dave
Messinger, N4QPM; and Chuck Mulligan, N4SDW.
''This is a very good day for Amateur Radio, and a very good day for justice,'' Petzolt said following the trial. ''Let the word go out
that we will not tolerate this sort of thing on our frequencies, and you will be caught.'' Petzolt cited local amateurs and the efforts of
the FCC, including Special Counsel for Enforcement Riley Hollingsworth ''and everyone else who kept the faith,'' for helping to
bring the case to a successful conclusion.
''Never give up and never surrender,'' Petzolt advised those facing similar malicious interference situations. ''If you do, they win.''
According to Petzolt, who testified in the trial, Flippo primarily had targeted the Jupiter Tequesta Repeater Group for jamming and
regularly interfered with amateur operations, especially on 10 and 2 meters, over an approximately three-year period. Following up on the amateurs' complaints, personnel from the FCC's Tampa District Office visited the Jupiter area at least twice in 1999 and reported
tracking the offending signals to Flippo's residence.
Federal authorities arrested Flippo in July 2000. The criminal charges of which he now stands convicted covered violations allegedly committed between June 1999 and April of 2000. The defendant already faces a $20,000 fine levied in 1999 for unlicensed operation, willful and malicious interference to Amateur
Radio communications, and failure to let the FCC inspect his radio equipment.
Hurley said he was worried that Flippo might not return to court for his sentencing hearing and ordered him returned to jail. Flippo reportedly hung his head after the jury returned a guilty verdict on the second count. He had no comment for a reporter as he was led back to jail.
Sentencing could take place in about a month. According to the FCC, Flippo faces a maximum penalty of eight years in prison--one year on
each count. He also faces up to $80,000 in fines.

big foot this man makes frezzerman look tame! Sadly there are more like him out there unlike a freebander who stays out of the way these people WANT to cause trouble. The rule amoung most HAMs is this when you cross into OUR bands ....yes frezzerman OUR bands you do it at your own risk. This man and several like him recked hell around florida for years... yes there are more but this is THEIR wake up call. Even on 10 meter fm they pop up and one in tampabay has already been located... these people are not hams even the 911 dialer was not a ham BUT he was the broadcats engineer for out local christian TV station... THAT's sad. It is so easy now to get a license that i realy dont understand the mentalty of thse people. I got licenced the first time at just days before i turned 14 and my tech license at 16 along with a first class radio telephone at 18 so its not a matter of age. Look at TAZ he reminds me of me at that age. At 14 i was in electronics school and at 18 had finshed it. Flippo and idiot's like him need to be delt with i hope they give him the max.

Maybe he was one of those wierdos that has no life, no job, no G/F, no friends, and is basically a social retard and a loser in life overall and gets off on making others miserable. He made it a point that NO one was going to tell him what to do. This man caused 3 years of problems here and even when the FCC fined him $20,000 he kept going claming he did not have the money to pay the fine! He had no use for HAMS and made that know to local news people at the same time he was claming to be too sick for the FCC to take him to trial. He could get 8 years and need to get it because the moment he is out it will start again.
