Just curious as to if the FCC can do anything when it comes to a grumpy neighbor complaining about interference with his touch lamps. I know this sounds a little far fetched but he's trying to report me and I have not had anything to do with running power. I do have a uniden washington but it's all stock except the resistor has been cut. Modulation is ok but just wanted to know that I've tried to make amends with this guy and he's dragging it out a little too much when it comes to my hobby. I'll move before I let him get me!! Ha! Any help would be great guys!!

The first thing I would do is put your limiter back in place. That could be the whole prob. If not, then you are 100% legal and there is nothing he can do. It is totaly his problem to deal with...Eddie

Boxcar THESE ARE THE FACTS
Under FCC rules if your radio is leagal HE is going to have to put up with it. As for touch lamps the fcc engineering dept may be able to answer that question how far can he go to " get " you. Part 15 clearly states all devices must put up with interfernce and that lamp is under part 15. Go to the fcc web site and look up part 15 for yourself if you still have questions and all else has failed write me at wa4gch@yahoo.com or to write the FCC engineering dept write Gary at ghendric@fcc.gov he realy is a nice guy...he will not bite your head off

He can report you, no doubt. And the FCC CAN investigate. To be safe, just make sure you are in compliance. If you have an unmodified rig, a low pass filter (a good quality one [Oak Bay or the like]), and a decent cable hooked to your antenna, I would think you've done everything to make your station as "clean" as possible. Then, if the FCC comes out, you have nothing to hide. You are doing the right thing in trying to work with him on these issues, but sometimes people can be hell bent on getting their way. But remember, you are protected by law and your neighbor should read the manual or stamp on his equipment that states that "this electronic device MUST accept external interference from other devices".....that's pretty clear. I've read some posts here that basically stae "screw em if they don't like it" kind of attiutude. If someone has ever had to actually deal with this problem, they know that it does nothing for your relationship with the neighbor and for the hobby. Try getting some ferrite core or beads at Palomar Engineers [ http://www.palomar-engineers.com/ ] and offer to wrap his speaker leads in them. You gotta get along with this guy if you're neighbors...I've done this with a hostile neighbor in the past and turned the relationship around. These are not that expensive either. The bottom line to it is, is it worth it to you to try and fix the problem?? Only you can answer that.--73

BRUCE IS RIGHT!

This is quoted from fcc

"If your station complies with all fcc rules and regulations then its your neighbors fault."

If you are complying with all fcc rules and regulations then he HAS to put up with it. EVERY ELECTRONIC DEVICE THAT IS IMPORTED INTO THIS COUNTRY IS U.L. LISTED AND COMPLIES WITH FCC RULES. His touchlamp says it on the bottom of it that it must accept all and any interference. Bummer and thats just the way it is. If you have a tower make sure its not about to fall over or anything because he could go and take the structure approach and try to have your tower taken down. My neighbor tried the same thing but he failed. My neighbor is playing all his cards, taking all his punches and hes losing big time.

THIS ISNT YOUR PROBLEM AND HE THINKS IT IS!

YOU ARE LEAGLE, HIS APPLIANCES ARE FAULTY!

TELL HIM THAT ITS NOT YOUR PROBLEM, ITS HIS PROBLEM!

Sorry for the yelling.

Touch lamps are VERY suceptable to rf . If the lamp is fcc accepted, then there is not much your neighbour can do. You can however offer to remove the touch device from the lamp and keep the peace.

I hear ya guys. I'm trying to do what I can first and that's be polite about it but the guy is really making a big deal out of nothing. I would definately invite anyone in this house just to have everything checked out and then I can do hand stands in the yard and make my neighbor feel like an idiot. The thing I don't get is as soon as the tower went up, my touch lamp didn't have any problems and his still does? Hmm? Must of bought his lamp at a local welfare lamp store then. We'll try the "kill 'em with kindness" and if that doesn't work, I'll book the next boxing bout on pay per view next to Mike Tyson and Lennox Lewis and we'll see what happens!!

73's to those helping me out!!

There are two perhaps three posible things that can happen.

One...
If you are licensed Amateur Radio Operator of tech plus or higher and you have modified the radio to make it operate better while at the same time not operate outside the parameters as set by the FCC then just invite the FCC in, serve them coffee and fear not.

If your radio is within the parameters of the rules an regs then your good neighbor will just have to fume.

Two...
If you are a Licensed Radio Operator tech plus or higher and you have not modified the radio internally, running it out of the box, you have nothing to fear.

The touch light owner will just have to suffer thru the tought times.

Three...
If you are not a licensed Amateur Radio Operator under the law you can own, and use the radio for listening purposes only. If you transmit in any way you will probably be held responsible and will find a notice of forfeiture in the mail with your name on it (and those can go into the tens of thousands of dollars/a 6000 buck fine is not unusual). One operator was recently fined 12,000 dollars for operating without a valid license.

On top of that the FCC can confiscate all your radio equipment deemed illegal.

If you refuse the FCC when they ask to examine your station they can return with federal marshalls and a federal search warrent, as many a Ham Operator has found out when the FCC has knocked on their door.

Bottom line,
if you are no sh*t straight up legal, it's not your problem (although being neighborly is quite respectable). If not, well..... definitely be neighborly and work hard to correct the problem. Good luck

Re Taz/in reply to 06/08/02 post

It also depends on what kind of rig he is running, any modifications and power.

First the rig/radio....
If he is running a factory spec FCC Approved CB radio no problem with the radio. BUT if he is running a 10 Meter rig then an inspection would find him at fault for using unauthorized equipement. Well that is an another story.

Second any modifications...
Some modifications that jack up modulation, power and such excede the specs and may interfere not only with lamps but also with other frequencies as well.

Third any power...
CB is limited to 4/12. If inspected and he is running in excess of the legal limit then he might be found to be at fault. And for certain the inspection team would not leave an illegal amp laying around. They would probably confiscate the entire station.

Now I know that running 4/12 sucks pond scum. As an Amateur Radio Operator for many ears I also started out in CB. And I also find that using crystal or PLL controll was a pain in the you know where. BUT remember good ol Coppers sells some dang nice beam antennas. And I am sure that they can advise anyone so the buyer can get the most bang for their buck. Why not just simply be legal get a super dooper beam antenna?

If you comply with all fcc rules and regulations you neighbor has to deal with it.

An fcc rep told me that.

Re Freez dude...

Reading the FCC Enforcement posts you get the very distinct impression that the FCC now means business. Fines of 6000 clams and higher are common these days.

They are quite serious about enforcing the law as best they can these days.

Perhaps you may have 6000 or 12000 to spare in the ol piggy bank but I sure do not. All I have in mine is dust and a few pennies. And yes one guy was fined 12,000. And 6000 fines are getting extremely common.
