just as an example...a HAM RADIO operator were to talk to his CB friends around 26 - 28 Mhz.... would he break a bigger fcc rule by 1) transmitting above or below cb channel 1 or 40 ... or 2) running excessive power ( 4 watt radio)... which is the worse of the two offences to the F C C ?? |

BIG FOOT, I think it depends on the circumstances. Running high power and bleeding police freqs will get you in a whole pile of more trouble than ragchewing on 28.XXX without a license. On the other hand interrupting non-amateuer FCC licensed freqs may get you in a lot more trouble than running 2K on channel 6. Stay where you belong (frequency wise), or where no one else belongs, and keep the power to a minimum and you shoudn't have much to worry about. Well for what my opinion is worth,now we are discussing "variables" of wrong. In either case both are illegal but that never stopped anyone before. I don't imagine one carries a more severe punishment than the other. |

mostly wondering for the benefit of AMATEUR radio licence holders since " HAMS are supposed to know better than average cb radio operators " ( according to some folks )...also does the F C C nic-pic over rule violations once they catch you for a BIG offence ? |

Hi Bigfoot: Transmitting out of band is just as illegal as transmitting with over 4 watts am or 12 watts pep SSB on CB 1-40ch...both are equal and one can be fined if you are a CB op or a Ham op. The FCC will not nic-pic but you will have your chance to tell your side of the story of course and the FCC will have its chance to rule on your case. If this guy is an Ham then he knows not only can he be fined like any CB operator but he also may lose his Ham License. Used to be that when you got a CB you had to fill out a form to the FCC for license and you were given FCC rules to read at that time....now no license, no rules handed out, but no doubt in my mind ALL know the rules. It is the choice of the person to break or follow the rules in any case be it on CB or Ham bands. I think that even kids understand rules and if they are breaking them so lets not assume Hams know better than CBers and I would highly doubt that anyone that has extra channels or uses High power doesn't know they are doing anything wrong. So if your Ham friend is doing this he is risking his License he worked for and extra Bands he might want to use.....as a CBer maybe one might want to think about getting more Band space and using high power legally buy getting a Ham license. big mistake all freebanders make is to think if the fcc wants them that no license makes a diffrence it dont as for what they know they dont need to know anyone who thinks you can hid and run a big bad radio in living in la la land... The fcc has no real intrest in inforcement on cb and no one to do it even if they did |

i saw this box/meter at a hamfest that measures field strength and rf that could possibly be used to bust power junkies out there or at least put an fcc cop near your home "20". antenna searching is easy after that. i agree with tech181... use the minimum that you need. it's like a 4 X 4 vehicle... see if you can get out of the mud without shifting into 4Hi or 4Lo, that's the fun of it. anyway, when i've put on my sneakers, people on the air know it and your neighbors know it and the airwaves get flooded with everybody else kickin up their boxes. it's an audio mess to see who knocks out the rest. xlaxx |
